With few exceptions, orders issued by a single commissioner may be appealed for review by a panel of commissioners. To request a review, either party may file a Form 30, Request for Commission Review, within fourteen days of receipt of the order. The appellant is required to pay a fee of $150.00 when filing an appeal.
Appeals from a decision and order issued by a Single Commissioner must be filed within 14 days. Appeals from decisions handed down by a panel of three commissioners or by the Full Commission must be filed with the Circuit Court within 30 days for injuries that occurred prior to July 1, 2007. Appeals from decisions handed down by a panel of three commissioners or by the Full Commission for injuries that occurred after July 1, 2007 must be filed with the Court of Appeals. Decisions of the Circuit Court may be appealed to the South Carolina Court of Appeals. There is no appeal beyond the state Supreme Court.
