Appellate Panel / Full Commission Decision & Order

I am dissatisfied with the Appellate Panel or Full Commission decision. What can I do?

Appeals from decisions handed down by a panel of three commissioners or by the Full Commission must be filed with the Circuit Court within 30 days for injuries that occurred prior to July 1, 2007. Appeals from decisions handed down by a panel of three commissioners or by the Full Commission must be filed with the Court of Appeals within in 30 days for injures that occurred after July 1, 2007 . Appeals beyond the Circuit Court or Court of Appeals are governed by the South Carolina Rules of Appellate Practice.

Failure to properly file an appeal with the correct tribunal within 30 days my result in the dismissal of the appeal. If an appeal is untimely, the Commission Decision & Order might become the law of the case. If you have received a Decision & Order from the Appellate Panel or the Full Commission promptly contact the Judicial Department if you require assistance. If you need a Full Commission/Appellate transcript contact the Appeals Department at 803-737-5737 or appeals@wcc.sc.gov.
