In response to stakeholder comments, the Commission promulgated an amendment to S.C. Code Ann. Regs. 67-610 that amends the existing process by which litigants before the Commission amend pleadings and add or remove parties to a claim. The amended regulation has been approved by the legislature and is effective May 26, 2023. The full advisory may be accessed here.

Cancellation of Insurance

South Carolina law requires insurance carriers to file policy information with its legal agent, National Council on Compensation Insurance (NCCI), within thirty days of the policy’s effective date. Carriers are required to provide the Employers’ Federal Identification Number (FEIN) on all policies.  Carriers failing to meet these requirements may be subject to fines. The procedures differ slightly for Self-Insureds and Self-Insured Funds. 

If the employer fails to renew its insurance, or the insurer cancels the policy, the employer's insurer must immediately notify the Commission's authorized agent by filing a  notice of termination through EDI. Notice is effective 30 days after receipt by NCCI. This procedure differs slightly for Self-Insureds and Self-Insured Funds.
